Choosing an Executor of My Estate: Who should I name? Choosing an Executor of my estate is a challenge. Here in Florida, we refer to the executor as the personal representative. The personal representative’s job is to properly administer the estate, which includes proper notification of creditors and dealing with creditor claims, and, ultimately, distributing assets of the estate according to the plan that the decedent had in place, or, if there was no plan, then we follow the statutes of the state of Florida. When deciding who to name as personal representative, you really want to look for somebody who, one, you trust completely and, secondly, if there’s the possibility of tension within the family dynamics – maybe it’s a second marriage – it’s very helpful if you can choose somebody who can remain neutral in their job of administrating the estate.
