Where should an original will be kept?

Most importantly, an original will should be kept in a safe and secure location. Many attorneys will hold original wills for clients. Another great place for a client to store a will would be in a fireproof safe in their own home, someplace that nobody else other than maybe the person whom they trust completely has access to the safe. Sometimes I get the question from clients about whether they should keep an original will in a safety deposit box. That’s certainly possible, but the client needs to think through if anybody else has access to that safety deposit box. If the answer is no, then, in all likelihood, someday when the client passes on, if probate is required, we will need to get a court order from a judge in order to open that safety deposit box. A lot of care must be taken if the will is going to be stored in a safety deposit box.
